Terms of Service

1. Agreement

These Terms of Service govern your use of the befound-agency.com website and the purchase of services from Be Found USA, LLC ("Be Found USA", "we", "us"). By using this website or purchasing services, you agree to these terms.

2. Consultation purchases

The $129 consultation includes a pre-call analysis of the materials you provide (website, business listings, and related marketing assets) and a scheduled call reviewing our findings and recommendations. The consultation fee is payable in advance and is non-refundable once the analysis work has begun. If you subsequently engage Be Found USA for ongoing services, the $129 fee is credited against your first month's invoice.

3. Services and engagements

Ongoing service engagements are described in a separate written scope provided to you before work begins. Unless otherwise stated in that scope, retainers are billed monthly and may be canceled by either party with written notice before the next billing cycle. Work completed and costs incurred prior to cancellation remain payable.

4. Client ownership

Upon payment in full, you own the deliverables we create for you — including your website, its content, and marketing accounts created on your behalf. Tools, systems, and software developed by Be Found USA for the delivery of services (including our reporting dashboard and content systems) remain the property of Be Found USA and are licensed to you for the duration of your engagement.

5. Your responsibilities

You are responsible for the accuracy of information you provide about your business, for having the rights to materials you supply (photos, logos, text), and for timely review and feedback where the scope requires it. We are not responsible for delays caused by missing information or approvals.

6. No guarantees of specific results

Marketing outcomes depend on factors outside any agency's control, including search engine algorithms, competitor behavior, and market conditions. We do not guarantee specific rankings, traffic, lead volume, or revenue. We do commit to transparent reporting of actual results.

7. Payment

Invoices are due upon receipt unless otherwise stated. Services may be paused for accounts with overdue balances. You are responsible for third-party costs that are part of your scope (such as advertising spend paid directly to Google), which are separate from our fees.

8. Limitation of liability

To the maximum extent permitted by law, Be Found USA's total liability arising out of or relating to any engagement is limited to the amounts you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits.

9. Governing law

These terms are governed by the laws of the State of Ohio. Any disputes shall be resolved in the state or federal courts located in Wood County, Ohio.

10. Changes

We may update these terms from time to time. The "last updated" date above reflects the current version. Continued use of the website or services after changes constitutes acceptance.
